ARC PROCESS CHANGES HB1203

The changes made to the ARC process in HB 1203 will undoubtedly create more challenges for associations that have a solid structure in place and have effectively managed their associations as required by their governing documents. It seems our legislators have responded to feedback from constituents in associations with potentially overreaching board and committee members. However, these laws may not improve the situation and could instead lead to more challenges in the future. As the saying goes, "the cure is sometimes worse than the remedy."

 

Despite these concerns, there are aspects of HB 1203 that I find commendable. Firstly, the requirement for ARCs to provide detailed reasons for denial, referencing the governing documents, enhances transparency and accountability in the decision-making process. Secondly, the introduction of an appeals process provides homeowners with a mechanism to challenge ARC decisions. However, I question the necessity of establishing a separate appeals committee, given the existing challenges in recruiting volunteers for committees.
