Can Rules Be Bent?

How far can a Board go when enforcing the community bylaws or rules and regulations? Are there instances where the rules should be bent?

 

Recently, a community in South Florida took aggressive action to ensure that, per their bylaws, "No commercial vehicles were allowed to be parked on community property".

 

This action was a result of insufficient parking spaces and a large number of occupants parking both their personal and work vehicles on the premesis. Sounds reasonable, right? All violators were given a 3-day notice to cure, becoming compliant by removing all commercial vehicles.  The problem came when a police officer was told he could no longer park his patrol car on the property! When he refused to comply, he was barraged by demand letters from the Board with threats that his vehicle would be towed at once!

 

As expected, many Homeowners became enraged and demanded a special meeting for the purpose of discussing the issue. After all who wouldn’t want a police vehicle parked next to their home??????? The majority of the homeowners believed it was a benefit to have a visible law enforcement vehicle on the property. The Board insisted that the rule had to apply to everyone. After a very heated meeting, the Board finally conceded to the demands of the Homeowners to bend this regulation for the good of the community.
