In both cases that Eric noted on Mondays blog, there are two glaring issues. The first is the unit owners were in the right. The second issue is, sometimes even when you are right, you lose and you need to walk away.


In my humble opinion, Attorneys, (sorry Eric, your exempt), have created an environment where individuals know in most cases that insurance carriers will pay to make an issue just go away! Therefore the attorneys (again, not you Eric) will take a case on contingency, getting as much as 50% of any settlement they negotiated.


A $250 claim can easily turn into a $2500 claim and the attorney makes $1200 and the owner makes $1200. Personally I believe any claim under $2500 should be limited to small claims action and that an attorney should not be allowed to take cases on contingency. This would result in lower insurance costs, smaller court dockets and far fewer frivolous claims.


Again, Eric and his firm are exempt from these statements.
