YOU CAN, BUT SHOULD YOU?

As Eric stated the Florida statute does allow for Boards to hire a Board member company to perform work for the Association. But just because you can, should you? More time than not we see these situations go south very quickly. It’s true there are occasions where it is a perfect solution for the Association. But Boards should consider all possible outcomes before going down this path!

 

·         Will the majority of the Homeowners be comfortable with your decision?

·         Has the Board been 100% transparent with the Homeowners?

·         Has the Board done thorough due diligence in vetting the Board Member campaign?

·         Suppose down the road there is a problem with the product which was used, even if it is a manufacturer defect. Who gets the blame? The Board!

·         What if one of the company’s employees acts out? Who gets the blame? The Board!

·         What if the Board Member is not as honest as the Board thinks and the work is sub-par. Who gets the blame? The Board!

 

I’m not saying, don’t do it. I’m just saying proceed with caution. Lots of caution.
