READ YOUR DOCUMENTS CLEARLY!

Time and time again we receive complaints from purchasers stating, “My sales agent said I could lease my unit” or “My sales agent said I could rent on VRBO or AIRBNB”. In several cases the seller or developer will put various approvals in the purchase and sale agreement that are in direct violation of the community declaration!

 

If it is in writing, as part of the sales and purchase agreement, purchasers believe they are protected! NOPE, you are not. If a sales person is granting you something, remember they do not sit on the board, they do not speak for the board and they have no authority to make decisions for the association.

 

If the seller or developer, put approval in the purchase contract, that contract is between the buyer and seller, and not the association. The developer is acting for the benefit of himself and not as a board member. Of course I am not an attorney, so before closing on a purchase where one of the aforementioned actions has taken place, please call your attorney and read your declaration!
