IT’S AN EMERGENCY AND NO ONE IS HOME

In real estate management, emergencies always seem to happen on weekends, holidays and in the middle of the night! NEVER during office hours. So what rights do the staff or board have to enter your home without your permission? According to Florida law (Source: Sun Sentinel):

 

“Florida law specifically states "the association has the irrevocable right of access to each unit during reasonable hours, when necessary for the maintenance, repair, or replacement of any common elements or of any portion of a unit to be maintained by the association pursuant to the declaration or as necessary to prevent damage to the common elements or to a unit or units." Based on Florida law, if the association needed to check association pipes that they suspected was causing damage or to prevent damage, such action was proper.”

The next question is, can the association charge you for repairs made on behalf of your unit? The answer is, yes and the best way of protecting your wallet is to purchase an HO6 policy. This will often times protect you or the owner from personal loss or expense caused by damage in your unit. I’m not an attorney, nor an insurance agent, but I have seen both of these issues at play over the years.
