Let’s Change It!

If your documents don‘t contain the phrase, “As amended from time to time”, who and how should the amendment process occur? While your CAM and the CAM firm might be great resources, remember they are not attorneys and should never give you legal advice. Additionally, amending your documents is a legal process and should be handled under the direction and supervision of the Associations attorneys.

 

Your CAM can work with the Board to identify areas where the current documents are outdated or simply don’t apply in today’s society. Once the Board has compiled a list of desired amendments, the attorneys can prepare the statute required documents and notices for the Homeowners. Once the proper notice, meeting and voting has occurred, the amendments are recorded and become a permanent part of the documents. Remember to ask your attorney to add the phrase “as amended from time to time” so that as the state statute is updated, so are your documents and to fully disclose which amendments might call for current owners to be grandfathered in, according to the old documents. After all, you don’t want to end up in court trying to enforce the unenforceable.
