WHO IS RESPONSIBLE FOR GETTING BIDS AND OVERSEEING INTERIOR REPAIRS?

Having just experienced a major water leak in a 21 story high rise, it became apparent that the unit owners don’t understand what the process is, and what they are responsible for handling.

The background history is simple. During the annual fire/sprinkler inspections, a sprinkler head broke off (prior to the system being drained) and flooded approximately 30 units. Management responded immediately, called out a remediation company and in speaking with the vendor, they assumed all responsibility for the disaster. The vendor’s insurance carrier and the association’s insurance carrier were put on notice. Unit owners were also advised to put their carriers on notice.

As adjusters were coming out to assess the damage, unit owners began demanding that either the board and or management should be responsible for calling contractors to get bids for their units so they could choose a vendor. Additionally they demanded to know, in writing, how the Board and Management would be supervising the repairs and how we would guarantee the quality of workmanship, replacement materials and safety of their personal belongings while work was underway. Owners were of the opinion that since a vendor hired by the board and management caused the problem, it was the board and managements responsibility to get their units repaired. Unfortunately, neither a board, nor management firm will assume the responsibility for interviewing, hiring or supervising repairs inside someone’s unit. I agree it’s a huge inconvenience for the damaged unit owner, however, the board and management will work tirelessly to ensure insurance proceeds are adequate to fund the cost of repairs. We cannot assume the liability for your interior repairs. What is satisfactory to us, may not be satisfactory for you!
