IS CHANGE ON THE HORIZON?

I completely agree with Eric’s blog on Monday stating that we all must look deeper at the issue and cannot and should not place all of the blame on the DPBR, but also the legislators! Does this blame sharing go farther? Yes, I believe so! Shouldn’t the attorneys who give ill advice to boards, on what may or may not happen if investigated by the DBPR, be held somewhat accountable? Shouldn’t the management companies who participate and take advantage of these ill-advised boards also be held responsible? ABSOLUTELY! There is blame to go around! If every board member were required to take an annual board certification class, I believe less of these issues would arise. If legislators passed more restrictive regulations for the bidding process, use of vendors who are owned fully or in part by a management company, and more hard punishment for violations, perhaps much of this nonsense would stop!

   

As we all know, the two main complaints the DBPR receives are lack of providing access to records and elections. So what if a law was passed requiring all records be made available to homeowners and be placed monthly on a community website. This eliminates the need to request them. Owners could simply log on and hit print! What if the association’s legal counsel was required to handle the election process? Yes, it might cost the associations money, but at least the “fixed elections” would be a thing of the past! What do you think?
