HERE'S ONE FOR THE BOOKS

The reports of widespread errors occurring during the foreclosure process are almost as numerous as the foreclosure themselves.

  
A luxury condominium community in central Florida is one of those cases.

A unit, which had not paid fees in a number of years, was foreclosed upon by the association. The foreclosure was handled by the association attorney and proceeded without incident. The association was awarded the title to the condominium, and all was good.

 

Right? WRONG! When the association received the title, they realized that the court clerk had transposed the unit number. For example, unit 403 was foreclosed on but the clerk wrote down unit 430. The attorney for the association was immediately notified of the error and we were informed the only way to correct the issue was to start the foreclosure process again, on the correct unit. As a side note, wouldn't it have been easier for the court clerk to redo the paperwork? After all, it was just a mistake!

The sale was restarted and guess what, someone (not the mortgage holder) came in and bought the unit out from underneath the association!

  
The board is currently weighing their legal options on if and how to proceed! I would like to hear your thoughts on this and what you think could or should have been done differently.
