DON’T READ MORE INTO THE LAW THAN INTENDED!

The law has passed providing for Associations to have the ability to recoup delinquent fees by collecting rent from occupants, of the unit, until such time the past due debt is satisfied. All the Association has to do is simply follow the procedure Eric set forth in his blog. But Boards beware! Having the ability to collect rent from a current tenant is very different from entering a vacant unit who is delinquent and outing a renter in place!! Lately we seem to be getting this direction from our Board, to which we must say NO CAN DO!!

 
The Association may not take possession of a delinquent unit until such that a lien is filed and possession is granted to the Association. Once this has been finalized, the Association may enter the unit, ready it for occupancy and rent it. However, the Board should make sure the cost to make it ready for move in doesn’t exceed the rental income they can collect.
